Terms of Service

1. Acceptance of Terms

By using MyNout or creating an account, you agree to these Terms of Service. If you do not agree, do not use the service. These Terms apply to all users regardless of how they access the service.

2. Description of the Service

MyNout is a web application for creating and managing notes. It allows you to create, edit and organise notes with rich formatting, tags and folders, with your content synced across devices. Access to the service requires creating an account.

3. Account Responsibilities

By creating an account you are responsible for:

• providing accurate and truthful registration information;
• keeping your login credentials confidential and not sharing access with others;
• all activities that occur under your account;
• immediately reporting any unauthorised access to your account to info@mynout.com.

Only one account per e-mail address is permitted. Accounts are non-transferable.

4. Acceptable Use

You agree not to:

• use the service for any unlawful purpose or in violation of applicable law;
• attempt to gain unauthorised access to systems, other accounts or any part of the infrastructure;
• access the service through automated means without prior written consent;
• transmit malware, viruses or other harmful or disruptive content;
• use the service in a manner that places an unreasonable load on the infrastructure.

We reserve the right to suspend or terminate access in the event of a violation of these rules.

5. Your Content

All content you create in the application (notes, tags, folders) remains exclusively your property. You do not transfer any copyright or other rights in your content to us.

You grant us only the limited technical permission to store, back up and display your content to the extent necessary to operate the service. This permission ends immediately when the content or account is deleted.

You can export your content as Markdown files (.md) at any time directly from the editor. We take responsibility for infrastructure-level backups, but we recommend downloading your own backups regularly.

6. Availability and Warranty Disclaimer

The service is provided "as is" and "as available", without any express or implied warranties. This does not affect your statutory rights as a consumer.

We do not guarantee 100% uptime. Planned and unplanned outages may occur due to maintenance, updates or unforeseen events. We will aim to minimise downtime and to notify users in advance where possible.

7. Limitation of Liability

To the extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential damages arising from your use of or inability to use the service, including loss of data. Our total liability to you will not exceed the amount you paid us, if any, for access to the service in the preceding 12 months.

This limitation does not apply to liability for intentional misconduct or gross negligence, nor to liability for personal injury.

8. Termination

By you: You may delete your account at any time via Settings → Delete account. This immediately and permanently terminates your access and all your data is irreversibly deleted.

By us: We reserve the right to suspend or terminate your access for serious or repeated violation of these Terms, or if the service is discontinued. Where possible we will notify you in advance and allow you to export your data.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via an in-app notice or by e-mail at least 14 days before the changes take effect. Continuing to use the service after that period constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the law of Czechia. Any disputes will be resolved by negotiation in the first instance. If an amicable resolution cannot be reached, the competent courts of Czechia shall have jurisdiction, unless mandatory law provides otherwise.
